Understanding Motions To Reconsider & Reopen
Motions can be done for two different reasons. The first is that there has been a change in circumstances since the original denial. An example might be pending criminal charges being the reason for a denial, but the applicant having been acquitted or seen the charges dropped. Motions filed on these grounds are called a motion to reopen.
The second kind of motion is when there has been an error in how an immigration official applied the relevant law. Motions for this reason are called a motion to reconsider.
Both kinds of motions use the I-290 B Form and are filed with the Administrative Appeals Office (AAO).
